Is There A Time Limit To Making A Compensation Claim Via The CICA?
You may wonder, ‘how long do I have to claim criminal injury compensation?’. When claiming via the CICA, as an adult at the time of the incident, you generally have two years to start your claim. However, the CICA recommends applying without delay unless exceptional circumstances prevent you from doing so.

Assault Claim Calculator – What Assault Compensation Could You Receive?
There are different types of potential criminal injury compensation that could be awarded for a successful claim made through the CICA. Firstly, we will examine how much compensation could be awarded for different physical and mental injuries.
The Scheme states that the CICA can award compensation for up to three qualifying injuries. However, a multiple injury formula will be applied. This is:
- The most serious injury – 100% of the tariff amount.
- The injury valued as the second highest or equal – 30% of the tariff amount.
- The injury valued as the third highest or equal – 15% of the tariff amount.
Furthermore, there are certain instances where the CICA could award an additional tariff payment. This includes instances where you have lost a foetus, become pregnant or caught a sexually transmitted disease as a direct result of the assault.

Special Expenses In A Criminal Injuries Compensation Claim
Furthermore, the CICA could award compensation for certain financial losses such as loss of earnings. To receive a loss of earnings payment, your injury must have been serious enough to have stopped you from undertaking any form of paid work or caused you to have a very limited capacity to undertake paid work for more than 28 weeks. From week 29 onwards, you could receive compensation for loss of earnings. Before this point, you could be eligible for Statutory Sick Pay.
Alternatively, other financial losses claimed under special expenses can be paid from the date of the incident, including:
- The cost of care relating to bodily functions or food preparation.
- Home adaptations, such as adding a ramp due to a disability caused by your injuries.
- Equipment relied on as a physical aid that was damaged in the incident, such as a hearing aid or glasses.
- The cost of medical treatment by the NHS.
- Equipment to aid you in coping with your injuries, such as a specially adapted car.
To be eligible to receive special expenses, your injuries must be so serious that you have suffered loss of earnings or an effect on your capacity to earn for more than 28 weeks. Also, the above costs must be deemed necessary, directly resulting from your injuries and not available elsewhere for free.
