A crime of violence, according to the Criminal Injury Compensation Scheme 2012, is a violent attack or omission that causes harm or a threat of attack. As per their definition, it could include common assault, sexual assault, or arson, for example.

Examples Of CICA Payouts – What Is My Potential Compensation Amount?

When looking at examples of CICA payouts, there are set amounts for injuries. The amount you receive could be based on various factors, including: 

  • The extent of the injury
  • The physical and psychological impacts of the injury
  • Whether any permanent symptoms were caused

Your criminal injury will be valued in accordance with the criminal injury tariff provided in the Criminal Injuries Compensation Scheme. You can claim for up to 3 injuries from this main tariff. However, they will be subject to the following formula: 

  • For your highest-valued injury, you would receive 100% of the tariff amount
  • Your second-highest would allow 30% of the tariff compensation
  • Your third-highest would allow 15% of the tariff amount

Payments could be made from a separate tariff if, for example, you contracted an STI or became pregnant as the result of a violent crime. These payments would not be subject to the formula above.

When Can You Claim For Special Expenses?

When you claim through the CICA, you could be entitled to a payment for special expenses. 

You must meet eligibility criteria to claim special expenses, which must be reasonable, necessary and incurred as a direct result of the violent crime. In addition, you need to show that you have experienced a loss of earnings or a reduced earning capacity (or have been incapacitated to a similar extent) for over 28 weeks.

If any equipment you rely on, such as glasses, was damaged in the incident, you could claim for this through special expenses. You could also claim back the cost of medical care from the NHS, or from another service that would have charged the same as the NHS. The cost of car or home adaptations that you need because of your condition could also be taken into account. 

You could also receive a loss of earnings payment. If you claim a loss of earnings, you must show that you had a total inability or seriously reduced ability to work for over 28 full weeks. You will not be compensated for loss of earnings for the first 28 weeks. 

When Are You Eligible To Claim Compensation From The CICA?

In order to claim, you must meet the requirements listed below: 

  • You must have reported the incident to the police. 
  • You must be within the time limit for claiming.
  • It must have happened in England, Scotland, Wales, or another relevant place.

Is There A Time Limit To Make A Claim Through The CICA?

When you claim through the CICA, you may wonder how long you have to claim.  There is generally a two-year time limit, which begins when you report the event to the police. You should report an incident to the police as soon as reasonably possible unless you can prove that exceptional circumstances prevented you from doing so. 

If a person was under eighteen at the time of the incident and a claim was not made, but it was reported to the police, the person has two years from their eighteenth birthday to claim. If the incident was not reported to the police, they have two years from the date they reported it to claim and they should report it as soon as possible once they are able to.
