When Can You Make A Criminal Burn Injury Claim?

A criminal burn injury claim can be made through the Criminal Injuries Compensation Authority (CICA). This Ministry of Justice-sponsored agency was established to compensate victims or violent crimes for their injuries.

They administer and use the Criminal Injuries Compensation Scheme 2012 to determine valid claims and how much compensation could be awarded for various criminal injuries.

The eligibility criteria to make a criminal burn injury claim through the CICA are as follows.

  1. You were the victim of a crime of violence as defined by the CICA. The Scheme lists some examples of this, including common assault, actors of arson and sexual abuse.
  2. This crime occurred in England, Scotland or Wales, or in another relevant place.
  3. The crime was reported to the police.
  4. The claim must be started within the time limit. We will discuss what this time limit is later in this guide

Could I Make A Criminal Burn Injury Claim Against A Vicariously Liable Party?

Before making a criminal burn injury claim through the CICA, you will need to prove that you were unable to claim compensation via any other avenue. For example, you were unable to claim directly against the perpetrator (for example, you may not have known who they were), or against a vicariously liable party.

A vicarious liability claim is where you claim against an organisation that bears a degree of responsibility for the crime occurring. For example, if you were assaulted at work by a colleague and suffered burn injuries, your employer could be vicariously liable if they had failed to take steps to protect you from this colleague despite making them aware of threats your colleague was making towards you.

If you have suffered severe burns, such as a third degree burn, in a crime of violence, you can contact our advisors to see whether you may be eligible to claim burn injury compensation through the CICA.

How Long Do You Have To Make A Criminal Burn Injury Claim Through The CICA?

A typical criminal burn injury claim made through the CICA will need to be started within 2 years of the crime occurring. This time limit may be extended should exceptional circumstances apply. However, these exceptions will be assessed on a case-by-case basis.

For crimes that occurred while you were a minor, the time limits are as follows:

  • If the incident was reported to the police, you will have 2 years from your 18th birthday to begin the claiming process (unless exceptional circumstances apply).
  • If the incident was not reported, you will have two years from the date you make this report to start your claim, provided that exceptional circumstances don’t apply.

For information on how long you have to claim criminal injury compensation, contact our advisors today using the information provided above.

What Do You Need To Claim Criminal Injuries Compensation?

In order to make a criminal injury burn claim through the CICA, you will need to submit specific forms of evidence. This evidence includes:

  • Your police reference number: you will be given a police reference number when the crime is reported, and you cannot claim through the CICA without one, so it is key that the crime is reported.
  • Evidence you satisfy the residency requirements.
  • Medical evidence stating the injuries that you are claiming for.

If there is any additional evidence or information the CICA may need regarding your claim, they will be able to liaise with the police for this.

Burn Injury Compensation Payouts Through The CICA

If you make a successful criminal burn injury claim through the CICA, you will be awarded compensation for your injury. Where the burn is located, and the severity of it will affect how much you receive compensation.

The CICA will refer to the tariff of injuries within the Scheme to determine how much compensation you are owed for your injury. These tariff amounts are fixed, meaning you will receive exactly what is listed for your injury if your claim is a success.

Below you will find some examples of CICA payouts that could be awarded for various burn injuries. Please note, however, that the first entry is not featured within the tariff of injuries listed within the Scheme.

Compensation may also be awarded differently in cases where you have lost a foetus, became pregnant or contracted a sexually transmitted infection (STI) due to the crime of violence.

Loss of Earnings and Special Expenses Payments

Additionally, you may be able to receive special expenses as part of your claim. Under this, you could receive:

  • Any equipment that was damaged in the incident that you relied upon as a physical aid.
  • Care costs relating to help with food preparation of your bodily functions.
  • Home adjustments to help you cope with your injuries.
  • Equipment to help you cope with your injuries.

You may also be able to receive compensation for any loss of earnings you have experienced. However, certain eligibility requirements must be met for this.

Make A No Win No Fee Criminal Burn Injury Claim

One of the criminal injury solicitors on our panel could help you make a burn injury compensation claim through the CICA, provided that you have an eligible case. Additionally, if they agree to take on your claim, they may offer their services to you under a Conditional Fee Agreement (CFA).

A CFA is a type of No Win No Fee contract that offers you various benefits. These include:

  • Not having to pay anything to your solicitor for their services before the claim begins.
  • No service fees to pay during the claims process.
  • If the criminal burn injury claim is not a success, you will not be required to pay your solicitor for the work they have provided.
  • Should you successfully be awarded compensation, a success fee will be deducted from this by your solicitor. The law implements a cap for the percentage your solicitor can legally take as this success fee.
